Demolition is not the first step in renovation

Last week, my wife and I decided that we wanted to update a couple of specific items in two of our bathrooms. The master bathroom needed a new shower enclosure and the half bath needed a new sink and a coat of paint. Neither of these projects should have taxed our collective home improvement knowledge, and should have never taken more than a weekend, combined. Colorado ignores film and ignores potential revenue.

Colorado has been missing a huge source of virtually free stimulus money since the 1990’s. HB 1180 addresses this incredibly short sighted policy decision, but is it enough?

Revised FTC guidelines for Testimonials and Endorsements

Have you updated your endorsements and testimonials in your marketing efforts to follow the new FTC guidelines (effective December 1, 2009)?

On October 5, 2009, the FTC released its final revisions to the guidelines given to advertisers to comply with the FTC Act. The FTC publishes these guidelines to let the public know how they will review the endorsements and testimonials used by advertisers. “The Guides set forth the general principles that the Commission will use in evaluating endorsements and testimonials, together with examples illustrating the application of those principles.” An advertiser, marketer or any person using endorsements and testimonials can use these guidelines to evaluate their own use and be reasonably certain of their compliance. The revisions to the guidelines took effect on December 1, 2009 and you should be aware or what has changed. I certainly don’t intend the following to substitute speaking with counsel or reading the guidelines yourself, but hopefully it will alert you to your responsibilities.

Is Yelp a genuine service?

Has Yelp engaged in wrongful conduct? It does if they use bad reviews to extort small business. http://www.inc.com/news/articles/2010/02/yelp-class-action-suit.html

The meat of the article is whether or not Yelp is offering an advertising service or extorting small businesses by offering to remove or hide negative reviews for a monthly fee. However, the knowledge of Yelp’s advertising scheme alone reduces the value of Yelp’s service to businesses and customers as a whole.
